Standard Terms and Conditions for the Sale of Artwork

Introduction
These terms and conditions (the “Terms and Conditions“) apply to the sale of any piece of art (the “Artwork“) in the collection by Allan Holman (the “Seller”) to you.

Title and Risk
As soon as the purchase price is paid in full, you will become the legal owner of the Artwork and, upon such payment, you will be responsible for the Artwork and the risk of damage to or loss of the Artwork will pass to you.

Ownership Of The Artwork Copyright
Copyright in the Artwork remains the property of the Artist.

Data protection
We may collect, hold, control, use and transmit personally identifiable information obtained from you in the course of your purchase of the Artwork. By agreeing to these Terms and Conditions you agree to such information being used in these ways and for such information to be disclosed if you are in breach of your obligations under these terms and conditions.

Liability of The Seller
We make no representation or warranty of any kind whatsoever, express or implied, in connection with the Artwork. The Seller excludes all liability (whether in contact, tort or otherwise), to the fullest extent permitted by applicable law, for any loss or damage that may result to you or a third party in connection with the Artwork. We don’t guarantee the condition of any frames on framed artwork. We describe the condition of the actual artwork as best we can. Shipping framed artwork with glass is risky, at best and we recommend that it be shipped without glass. The package will weigh less and it’s less expensive to ship, as well. This can be discussed at the time of purchase.

Rights of Third Parties
No person other than you and the Seller have any rights under these Terms and Conditions.

Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with Canadian law. Disputes arising in connection with this legal notice shall be subject to the exclusive jurisdiction of the Canadian courts.

Shipping Policies

Turnaround
All orders are shipped within 72 hours of payment being received and cleared Monday – Friday 8am – 5pm.

Carriers
We use the following carrier to deliver our orders: Canada Post, unless the size of the package is beyond their handling capabilities. We would then use a courier service such as Fedex, UPS, Purolator or a courier requested by the buyer.

Order Tracking
If a tracking # is provided by the shipping carrier, we will update your order with the tracking information.

Shipping Rates

The rate charged for the shipping of your order is based on the weight of your products, the size of the package and your location. Before the final checkout page you will be shown what the cost of shipping will be, and you will have a chance to not place your order if you decide not to. Shipping will be discussed for every purchase by telephone or e-mail.

Privacy Policy
This policy covers how we use your personal information. We take your privacy very seriously and will take all measures to protect your personal information.

What Information Do We Collect?
We only collect information that we need that is related to your order. This includes your Full Name, Billing Address, Shipping Address, Email Address, Credit Card Information and a phone number.
In addition, we also collect information on your IP address, browser type, and referral URL data. We use this data to prevent hacking attempts, help us know what web browsers people are using, and to find out where our visitors are coming from to assist in analytics tracking and data analysis.

How Is My Information Used?
Your information is only used internally to fill your order. We will never sell or redistribute your information to third parties.

Security and Storage
Only your order data billing, shipping, and order contents data are stored on our server. This information is encrypted using a Secure Sockets Layer with 264 bit encryption before it is transmitted over a web server. We do not store your Credit Card data.

Cookies and Browser Information
Cookies are small files that reside on your computer and allow us to recognize you on your next visit or store your shopping cart contents. We use them only to track this information.

Taxes
Local customs, duties, and taxes may apply. Any taxes, tariffs, duties, or customs fees are the responsibility of the purchaser.

Credit Card Charges
Your credit card will be charged when you place your order. If we are not able to fulfill your order for any reason, your credit card will be refunded.
Cheques/Money Orders/Electronic Funds Transfer Payments

Your order will not be fulfilled until payment has been received in full. If we are not able to fulfill your order for any reason, your original payment method will be credited.
